By submitting a completed application form via www.movementlab.cz the participant enters into a contract for the provision of services, consents to these General Terms and Conditions, and confirms that he/she has read them and agrees with them.
The General Terms and Conditions (hereinafter "GTC") govern the legal relationship between Movement Factory, z.s., ID: 08622396, with registered offices at Malé náměstí 76, 391 81 Veselí nad Lužnicí (hereinafter the "Promoter") and the participant or their legal guardian, (hereinafter the "Participant") that follows from the contract on the provision of services, or the application to participate in Movement Lab dance workshops (hereinafter "Movement Lab") and the related Best Lab Dancer (hereinafter "Best Lab Dancer"). The GTC govern the mutual rights and obligations of the Promoter and the Participant in relation to Movement Lab and Best Lab Dancer.
1. BASIC DEFINITIONS
1.1. Movement Lab means dance workshops with international instructors held on dates specified on the website www.movementlab.cz and intended for dancers in two age categories.
1.2. Best Lab Dancer means a competition taking place within the Movement Lab pursuant to the conditions defined below in these GTC.
1.3. The organizer of Movement Lab and Best Lab Dancer is the company Movement Factory, z.s., ID: 08622396, with registered office at Malé náměstí 76, 391 81 Veselí nad Lužnicí, registered in the Commercial Register kept by the Regional Court in České Budějovice under file number 8442 L.
1.4. A participant is defined as a dancer (or their legal guardian) who has duly completed and submitted an application for participation in Movement Lab available at www.movementlab.cz.
1.5. Full Out Camp is a dance residency programme with international instructors held on dates specified on the www.fulloutcamp.cz website, intended for individual dancers and dance groups, organized by the Promoter (hereinafter "Full Out Camp").
2. APPLICATION FORM
2.1. The Participant applies to Movement Lab solely through a duly completed and submitted application form available on-line at www.movementlab.cz. By submitting the registration form, the Participant also automatically registers for the Best Lab Dancer competition, the terms and conditions of which are specified in Article 6 of these GTC.
2.2. By submitting the application, the Participant confirms that they have read these GTC in full and that they agree with them fully and without reservation. These GTC are an integral part of the contract on the provision of services between the Promoter and the Participant.
2.3. By submitting the application, the Participant also confirms that they are sufficiently familiar with their state of health, which must fully permits their participation in Movement Lab workshops.
2.4. After the Promoter receives the application the Promoter will send the Participant an application confirmation, by which a contract on the provision of services is concluded between the Promoter and the Participant, through which the Participant undertakes to comply with these GTC.
2.5. The subject of the contract for provision of services is the Promoter's obligation to provide dance instruction services or other services according to the Movement Lab programme published on the web and the Participant's corresponding obligation to pay the agreed price to the Promoter for these services.
3. PRICE AND TERMS OF PAYMENT
3.1. The price of participation in the Movement Lab can be found at www.movementlab.cz and is due as soon as the application is sent.
3.2. The Participant shall pay the price of participation in the Movement Lab via bank transfer to the Promoter's account according to the Promoter's instructions on the website. In exceptional cases, arrangements can be made with the Promoter via email at info@movementlab.cz to pay the price of participation in the Movement Lab in cash upon arrival.
3.3. If the Participant does not pay the price of participation in the Movement Lab within 7 days of sending the application, it will be ignored. In exceptional cases, arrangements can be made with the Promoter via email at info@movementlab.cz to pay the price of participation in the Movement Lab after the specified deadline.
4. CANCELLATION POLICY
4.1. The Participant has the right to cancel registration at any time prior to the start of the Movement Lab in writing through an email sent to the address info@movementlab.cz, subject to the cancellation policy specified below.
4.2. If the Participant cancels their participation at least 15 days prior to the start of the Movement Lab, they have the right to a 100 % refund.
4.3. If the Participant cancels their participation less than 15 days prior to the start of the Movement Lab, they do not have the right to a refund of any amount.
4.4. Article 4.3 does not apply to cases when the Participant finds a substitute who assumes the contractual relationship in his or her stead; in doing so he or she is obliged to inform the Promoter of this fact without undue delay. The right to a refund pursuant to Article 4.3 is incurred the moment the substitute pays 100 % of the price.
4.5. Article 4.3 also does not apply to cases where the Participant cancels due to illness or injury. A 100 % refund is contingent on the Participant submitting a medical report proving an illness or injury preventing them from participating in Movement Lab workshops.
5. TERMS AND CONDITIONS OF THE SERVICE
5.1. The Promoter reserves the right to make changes in the agreed Movement Lab and Best Lab Dancer services and programmes. In this case, the Promoter must inform the Participant of such changes without undue delay.
5.2. If Movement Lab workshops or Best Lab Dance competition cannot take place due to force majeure, the Promoter has the right to not hold the Movement Lab workshops or Best Lab Dancer competition or end them prematurely without the right to a refund or other damages.
5.3. If a Participant provides untrue or incomplete personal information, the Promoter has the right to withdraw from the contract with the given Participant, meaning cancellation of their participation in the Movement Lab or Best Lab Dancer under the terms of the cancellation policy in Article 4.3.
5.4. The Promoter has the right to expel the Participant during the course of the Movement Lab due to the Participant's poor health (especially if the health of the Participant poses a risk to other individuals). If the Participant is expelled, the Participant shall bear all costs of the termination of their participation in the Movement Lab.
5.5. The Participant must inform the Promoter in writing regarding all known medical restrictions. By submitting the registration form, the Participant confirms that that their state of health allows them to participate in the Movement Lab. The Participant shall bear all risks related to aspects of their state of health of which the Promoter was not informed.
6. TERMS AND CONDITIONS OF THE BEST LAB DANCER COMPETITION
6.1. By participating in Movement Lab workshops the Participant is automatically eligible for participation in the Best Lab Dancer competition that will take place during the Movement Lab workshops.
6.2. The Best Lab Dancer competition has two age categories, and a winner will be declared in each category.
6.3. The Participants shall be evaluated for purposes of the Best Lab Dancer competition through a private vote of a jury composed of Movement Lab workshop instructors.
6.4. The jury will pick one winner in each age category from among the Participants. The voting will be based on each Participant's performance in all of the Movement Lab workshops.
6.5. Only a Participant who has attended 100 % of the Movement Lab programme, i.e. all of the workshops held as part of the Movement Lab in a given category may become a winner in that category.
6.6. The prize in the lower age category is a 100 % stipend for participation in the next Full Out Camp held after the Movement Lab. The Promoter shall give the winner in the lower age category a voucher that can be redeemed when the Participant registers for the next Full Out Camp when the winners of the Best Lab Dancer competition are announced at the end of the Movement Lab.
6.7. The winner of the higher age category will receive a cash prize of CZK 25,000. The Promoter shall send the winner of the higher age category the amount of CZK 25,000 via bank transfer to the bank account specified by the winner within 14 days of the end of the Movement Lab.
7. FINAL PROVISIONS
7.1. These GTC apply as of 27 May 2022.
7.2. The Promoter has the right to change these GTC at any time. The Promoter must always publish the current version of the GTC on his website. A new version of the GTC becomes effective with its publication on the Promoter's website. The Participant is bound by the version of the GTC effective on the date of the creation of the contract on provision of services. If any changes are made in these GTC after the contract for provision of services is concluded, the Promoter shall inform the Participant of the new version of the GTC. The Participant has the right to refuse the new version of the GTC.
7.3. If any provision of these GTC becomes invalid or ineffective, the validity of other provisions remains unaffected as does the validity and efficacy of these GTC as a whole. The contracting parties shall replace the invalid or ineffective provisions of these GTC withe valid or effective provisions that correspond as closely as possible to the sense and purpose of the invalid or ineffective provisions.
7.4. All contractual relationships that follow from these GTC or from the contract on the provision of services between the Promoter and the Participant are governed by generally applicable legislation of the Czech Republic.
7.5. The Promoter processes the Participant's personal data pursuant to the Terms and Conditions of Personal Data Processing.
